A trial begins in Los Angeles today to resolve a dispute between porn king Larry Flynt and his nephews over use of the Flynt name on a line of adult videos.

Larry Flynt is suing nephews Dustin and Jimmy Flynt II to stop them from using the well-known Flynt name for their new adult-video company.

According to the trademark infringement complaint filed last January in U.S. District Court in downtown Los Angeles, the Flynt nephews have advertised seven adult movies to be released under their Flynt Media Corp. company name.

Larry Flynt alleges that his nephews, who worked for him until last year, are “seeking to trade off and usurp the famous Flynt name” and trademark of their uncle in order to “confuse the public into buying their inferior products.”

Jury selection, marking the start of the trial, is expected this morning.

U.S. District Judge A. Howard Matz said earlier this year that he agreed with several of Larry Flynt’s points and ordered the nephews to place a large disclaimer on both their Web site and DVD packaging making clear the products are not in any way linked to the Larry Flynt brand.

“They don’t want to be affiliated with their uncle, but they do want to use their last name,” said Andrea M. Kimball, the nephews’ attorney.

The lawsuit states that Larry Flynt, through his various Larry Flynt Publishing companies, has used the Flynt name as a trademark since the early 1970s in connection with such entities as Hustler magazine and similar publications, adult-themed video and DVD releases, various Internet Web sites and adult-content stores.

The suit notes that Flynt was the subject of the 1996 film The People vs. Larry Flynt,” in which Flynt was depicted “heroically championing the rights of free expression under the First Amendment.”

European trade legislation binds us to collect the VAT on all the transactions made by European customers.
As a French company, we’re binded to collect and pay 19.6% VAT.

Reminder : what is the VAT (Value Added Tax)?
In Europe*, prices are subject to the VAT.
The law requires us to display all prices with taxes included and then to pay the VAT back to the government.
Online transactions are also submitted to the VAT and so we have to adapt our system to this law.

What impact for Totem?
Our prices have always been the same for both European customers and outside Europe customers, i.e. without the VAT.We could raise our prices of 19.6% for the European customers, but we chose to maintain the same price for the end user to avoid the risk of sales decrease, especially with so many return customers.
The Euro/USD exchange rate still covers for it (average x1.4 last months) so you’re still making more money with European customers as we pay you in USD.

What impact for you?
Current prices are then including the VAT.
It means that from now on, the VAT will be deducted from all European transactions and the revsharing amount will be calculated as follows in order to be consistent with the outside Europe transactions calculation:

My name is Adam Blake and I started shooting content for my sites probably around 10 years or so ago. Time so does fly by. My first site was in fact a model site. It was basic in design but got models work. But in time we found that some models were being harassed by rival model sites who charged (my site was free to contact the models direct). No more vagina for China!

The war against porn continues in China. Yahoo is now the number one foe. Yahoo China, the Chinese portal for Yahoo, offers Yahoo Space, a social networking device that includes the possibility of uploading photos.

Last month this service was closed, however the Chinese government focused its attention on it again, once the war on porn was strengthened due to a nation wide edict that imposed all citizens to install porn-blocking software on their PC’s.

With this scenario, the Internet Society of China – a group sponsored by the government – has claimed that Yahoo China and other local websites of going against social morals by allowing pornography to circulate through their domains.

In order to avoid any unwanted accusation, Yahoo even turned control over to a local company, Alibaba Group, so that they analyze the social context. It is obvious that the tense relationship between the online giant and the Chinese government had major impact on Yahoo’s future plans.

Entering in an agreement with Bing, which is known for it’s adult-friendly policy, didn’t make things any better. In fact, Rose Tsou from Yahoo explained that the latest ad campaign called “It’s You”, will not run at all in China.

And once they have finished with Yahoo, it’s Google’s turn to face the Internet Society of China and their demand to eradicate porn from Google.com search results. Men in China will certainly appreciate beauty products ads very soon…

Even censorship needs censorship

The World Trade Organization (WTO) is ready to conduct a study arguing that censorship of the Internet is open to challenge by the main regulatory body because of its restrictions on trade. Sovereignty discussions may arise, since member states can decide several restrictions, like banning access to child pornography or other services or products.

Using moral arguments against free trade, the WTO may impose some barriers on censorship itself and require the use of selective filtering. The study was summited by the European Center for International Political Economy (ECIPE), which according to their own statement are “an independent and non-profit policy research think tank dedicated to trade policy and other international economic policy issues of importance to Europe.”

The authors of the study, Brian Hindley and Hosuk Lee-Makiyama, explained their vision on the matter: “Censorship is the most important non-tariff barrier to the provision of online services, and a case might clarify the circumstances in which different forms of censorship are WTO-consistent.

Many WTO member states are legally obliged to permit an unrestricted supply of cross-border Internet services.” Plenty of cases where censorship severely affected business with moral and political backing have been reported. While the WTO agrees with certain blocking measures, all of these measures should not be highly generalized, but targeted. This way interference with international trade is tempered.

“There is a good chance that a panel might rule that permanent blocks on search engines, photo-sharing applications and other services are inconsistent with (WTO services) provisions, even given morals and security exceptions,” the report concluded. It seems that some national on line walls will soon become strainers…
